ONCE ACCEPTED, THESE TERMS OF SERVICE, IN COMBINATION WITH OUR PRIVACY POLICY (COLLECTIVELY THE “TERMS”), BECOME A BINDING LEGAL COMMITMENT BETWEEN YOU (OR THE BUSINESS ENTITY THAT YOU REPRESENT) AND Regenerative Root Healing, LLC AND ITS RESPECTIVE OFFICERS, DIRECTORS, SUCCESSORS AND ASSIGNS (HEREINAFTER REFERRED TO AS “Regenerative Root Healing,” “WE” OR “US”) AND WILL GOVERN YOUR ACCESS TO AND USE OF THIS WEBSITE AND PLATFORM AND ALL OTHER INTERACTIONS RELATED TO THE PLATFORM.

Regenerative Root Healing reserves the right to make changes to these Terms Of Service at any time. All changes are effective immediately when posted. Your use of my website, or me personally, following the posting of any revised Terms constitutes your acceptance and agreement to the updated Terms. Last Updated: 10/08/2024

Acceptance of Terms and Conditions: By completing the registration form for a particular workshop, you are agreeing to the terms and conditions set out below (“Terms”) and they will be incorporated into the contract between us.

1. Service Overview: Regenerative Root Healing offers services that include support and guidance with energy, nutrition, detoxification, herbal remedies, hydration, and does energy work, clears the emotional body from pain and trauma. We run group retreats, programs, workshops and courses in person and through a website portal.

2. Payments: The fee for attending the Workshop, Program, Class, Certification or Cohort (“Registration Fee”) will be as stated on the registration form for the relevant Workshop. All payments for the Registration Fee must be made in full at the time of completing the registration form and in any event prior to the date of the Workshop, unless other arrangements have been made. Payment plans for group programs are an option.

3. Refunds: All fees for any products or services at Regenerative Root Healing are non-refundable unless otherwise stated or required by law. Fees will be billed to the credit card on file. You are solely responsible for any excess Fees incurred by You as a result of an error or omission made by You or a third party. Regenerative Root Healing does not provide Fee refunds or credits for such errors or omissions. If you sign up for a subscription but do not access the Service or Platform, you are still responsible for all Fees during the term of your subscription. Except as may be required by law, Regenerative Root Healing reserves the right to issue or deny a refund or credit in its sole and absolute discretion, at any time, for any reason, and Regenerative Root Healing's determination of if and when to issue or deny a refund or credit is final.

All tickets for the Workshop shall be non-refundable except as set out in #4 and #5 below. However, if you are unable to attend the Workshop for any reason you may email us at [email protected] to provide us with the name of a substitute to attend the Workshop on your behalf and on receipt of this email we shall make such substitution and allow the substitute access to the Workshop. It all must be done at least 24 hours ahead of time.

4. Cancellation Policy: There may be circumstances in which we need to cancel the Workshop. In such circumstances, we will provide you with a full refund of the amount of the Registration Fee that you have paid to us and we will make every effort to provide you with such refund within 30 days of the date of cancellation.

5. Registration and Subscription: Monthly and annual subscriptions must be canceled a minimum of 7 days prior to the renewal date to avoid unwanted charges. Users are responsible for canceling services associated with their accounts, and no refunds will be provided for failure to do so. For canceling requests, please email us at [email protected].

Users may sign up for services and programs via the website and subscribe to the services offered, agreeing to these Terms of Service in the process. Monthly subscriptions are billed on the subscription day every month, while annual subscriptions are billed on the subscription date every year.

6. Termination: Regenerative Root Healing reserves the right to terminate or suspend access to the platform and services at its discretion, with or without cause, and without prior notice.

7. Intended Use: Users agree to use the platform only for lawful purposes and in accordance with these Terms of Service. Users are responsible for maintaining necessary licenses, permissions, and authorizations, and Regenerative Root Healing is not liable for misuse of the platform.

8. Login Credentials:

✔️ Confidentiality: You are responsible for maintaining the confidentiality of your Login Credentials. You agree not to share your Login Credentials with any third party and to take reasonable measures to protect them from unauthorized access.

✔️ Account Security: You are responsible for all activities that occur under your Platform Account, whether or not authorized by you. You agree to notify Regenerative Root Healing immediately of any unauthorized access to or use of your Platform Account or Login Credentials or any other breach of security.

✔️ Disabling Credentials: Regenerative Root Healing reserves the right to disable your Login Credentials at any time in its sole discretion for any or no reason, including if, in Regenerative Root Healing’s opinion, you have violated any provision of these Terms.

✔️ Non-transferability: Platform Accounts are non-transferable. You may not transfer or assign your Platform Account or Login Credentials to any other party without the prior written consent of Regenerative Root Healing.

✔️ Preventative Measures: You are obligated to take preventative measures to prohibit unauthorized users from accessing your Platform Account with your Login Credentials. This includes implementing strong password practices and maintaining the security of your devices and networks.

9. Postponement or Change to Venue: There may be circumstances in which we need to postpone the Workshop or change the venue at which Workshop is to be held and if we do, we shall advise you of this as soon as we possibly can.

10. Liability and Disclaimer – Important To Read This! Our sole liability in relation to any cancellation, postponement or change of venue shall be limited to the price paid by you for such Workshop and we shall not be liable under any circumstances for any consequential losses. In providing this workshop, no person is acting as your solicitor or providing you with legal advice. We are providing you with training, template documents and guidance.

11. Your Obligations: If you act in any way which in our opinion is likely to cause any harm or nuisance to any person at the Workshop, you will be required to leave the Workshop and we shall not be liable to refund your Registration Fee or any other payment. You must comply at all times with the health and safety policy of the venue. You must comply with all requests from us or the venue with regard to health and safety and failure to do so will result in you being asked to leave the workshop (in which case no refund will be provided).

You may not bring any equipment or items of a hazardous or dangerous nature to the Workshop. You shall not cause any damage to any part of the venue (including outside areas, and all inside walls, flooring, fixtures and fittings). You are solely liable for any damage caused by you, your employees, contractors, sub-contractors and agents to any such area of the venue and shall fully reimburse us in relation to any damage so caused. You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to the Workshop by you.

12. Promotional Materials and Materials at the Workshop: You agree that we may include your details in any promotional materials relating to the Workshop and/or any materials used at the Workshop. We are not liable for errors or omissions contained in such information. Unless otherwise stated, the copyright for any such promotional materials and any materials used at the Workshop (including course notes, slides, brochures, articles and case studies) belongs to us and may not be reproduced in any medium without our prior written consent. You may use such materials for your own business purposes only and may not reproduce, publish or deal with such materials in any way for any commercial use.

13. Photography and Filming: We may wish to photograph or film the Workshop and reserve the right to do so for the purposes of promoting future workshops or otherwise. You consent to us (or any other person attending the Workshop) photographing or filming you and any persons attending the Workshop with you. You may not photograph or video the Workshop without our prior consent.

14. Data Protection: We will communicate with you using the contact details provided on the Registration Form for the purposes of the Workshop or future workshops or classes. We do not share or sell your contact information to anyone ever.

15. Disability, Medical Conditions and Dietary Requirements: If you have any disability or medical condition that requires us to make special arrangements for you or any special dietary requirements, please email us at [email protected] as soon as possible and in any workshop at least 2 weeks prior to the date of the Workshop.

16. Limitations of Liability: Whilst every reasonable precaution is taken by us to ensure security and safety at the workshop, we shall not in any way be liable for any loss or damage suffered by you whatsoever in relation to the Workshop, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by negligence.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, any fraudulent misrepresentation or any other liability for which it is unlawful to exclude or limit liability. Our total liability for any matter arising out of the Contract shall in all circumstances be limited to the price paid by you for the Workshop and we shall not in any circumstances be liable to you for any consequential loss whatsoever.

17. 17. Governing Law: This Agreement shall be construed in accordance with, and governed in all respects by, the laws of the State of New Mexico, without regard to conflicts of law principles

18. 18. Damages: Beyond ordinary wear and tear, participants shall be responsible for any damage caused by Participants use of the Space. Participants shall pay for the repair of damages at the cost that the Owners set (based on the Owners getting 3 separate and fair estimates for the damage repairs). It's the Participant's due diligence to give this information (in the form of contracts or terms and conditions) to their clients that come in for workshops, treatments, classes or events. Please respect the furnishings and decor at the Workshop site. You agree not to dismantle or damage the furniture or decor in any way and agree that you are responsible if damages to such items occurs.

This Agreement constitutes the entire agreement between Participant and Owners, and supersedes any prior understanding or representation of any kind (i.e. text messages, emails, verbal agreements) preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement. IN WITNESS THEREOF, the Parties have caused this Agreement to be executed the day and year first above written.
We may, at any time, and at our sole discretion, modify these Terms and Conditions of Use, including our Privacy Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms.
